Not really, you are knowingly living here with an expired visa, you had ample opportunity to plan, reapply, change status, and my other options, they just…didn’t. So, as a non citizen with an expired visa they no longer have freedom of movement (as a visa grants you specifically, freedom of movement within the borders of the United States and it’s Territories)

Judicial review was established in 1803, and was just never objected to because neither of the other 2 branches want to do the job (and IMO they immediately recognized the tool or weapon it could be)

Explain to me why this should apply to a visa applicant? They are not here yet, they are still within their country and want to enter here so your “on American soil” argument doesn’t make sense. Seems pretty reasonable to me to be actually vetting people who enter a country. By actual investigative means and not arbitrary ones.
